Terms and Conditions

Scope

The general terms and conditions of Liedl & Gronemann GmbH - ARCHIDELIS Modellbaumaterial, henceforth called ARCHIDELIS, are valid for all present and future business relations between us and our customers.
Different agreements are valid only if confirmed by ARCHIDELIS in writing.
Our customers agree to these terms and conditions by placing an order.
The contract language is German.

Offer

The customer’s order constitutes an offer and is binding.
The contract comes into effect by ARCHIDELIS accepting the order, at the latest on shipment.
In case we are not able to meet an order, we will inform the customer as soon as possible by e-mail.

Prices

All quoted prices are in EUR (€) including V.A.T, per sales unit, excluding shipment costs, from Vienna. Shipment costs are extra and are to be paid by the customer (see Shipment and Costs).
For shipment to non-EU countries any customs duties, expenses and charges as well as banking fees are to be borne by the customer.
For mistakes and errors in pricing no liability is assumed. Our offers are subject to change and without obligation. Offers are valid while stocks last.

Minimum Order Value, Terms of Payment and Discount

The minimum order value is € 20,00.

For shipment within Austria there are the options of paying by cash on delivery or credit card (Visa, Master Card). Shipments within and outside the EU can be paid by credit card only.
The fee for cash on delivery is to be borne by the customer (see Shipment and Costs).

Depending on the quantity ordered we offer the following discount:
Minimum order value of € 90,-- 2% discount, minimum order value of € 250,-- 5 % discount, minimum order value of € 450,-- 8 % discount.
Machines, Machines-Accessories and special offers are not discountable.
Regular customer cards do not apply in mail-order trade.

Shipment

We handle our shipments by Austrian Post as standard. For shipments exceeding the maximum weight accepted by Austrian Post we will contact the customer.
For items exceeding a length of 96 cm and for packages exceeding a total of 100 x 60 x 60 cm, the surcharge for bulky goods has to be borne by the customer (see Shipment and Costs).
Deliveries will not be made to P.O. boxes and packing stations.
In case we cannot or can only partly fulfil an order, we will inform the customer by e-mail as soon as possible.
Items not in stock at the time of shipment will not be forwarded unless by explicit customer request.
Delivery times indicated are standard values that cannot be guaranteed. We assume no liability for delivery delays and consequential damage.
Shipment is at the risk of the recipient.

Retention of Title

The delivered goods remain property of ARCHIDELIS until receipt of full payment. In case of payment delay of the customer we are entitled to claim all rights from the retention of title.
It is agreed that assertion of claims from the retention of title does not establish withdrawal from the contract unless declared by us explicitly.

Right of Withdrawal

Customers who are consumers as defined in the Austrian Consumer Protection Act (§ 1 Abs 1 Z 2) or in comparable acts in their respective countries of residence can cancel a contract resulting from a web-order within 14 days from the receipt of the shipment of ordered goods.
It is sufficient to send a notice of cancellation or the merchandises themselves within the time limit without stating any reason.
In case of withdrawal a complete or partial refund of the purchase price of the goods only takes place concurrently to return of the goods by the customer. Shipping costs are not refunded.
The goods shall be returned in unused condition in original packaging so that they can be sold as new.
For goods showing signs of use we will charge appropriate compensation.
The same applies if parts or accessories of the returned goods are missing.
The right of withdrawal does not apply to products beyond our regular assortment and therefore having been ordered especially on request, furthermore to individual cuts and sections of reel material.
The costs of return are to be borne by the customer. If goods are resent freight forward we shall be entitled to retain or to invoice the appropriate amount.

The statutory warranty regulations apply.

Liability and Compensation

Liability can be assumed neither for the completeness and accuracy of product information nor for consequential loss resulting from delay in delivery.
Claims for damages shall be excluded in the event of slight negligence. This does not apply in case of personal injury or of product liability claims.

Data Privacy Statement

We save the data of our customers for the only purpose of handling their orders. At any time they have the right to free information, correction, blocking and deletion of personal data. Corresponding requests can be conveyed by our web contact form, e-mail, letter or fax.
We do not forward any personal data including home adress or e-mail adress to third parties without explicit revocable consent. Excepted thereof is the transmission of data to our associated service partners who need information for executing orders and who are subject to privacy policies on their part (e.g. the transportation company commissioned to execute deliveries and the credit institute commissioned to execute payments). In these cases the amount of data supplied is limited to the required minimum.

We use technical security measures to protect all personal data administered by us against unauthorized access. Our data is transmitted by SSL (256-bit encryption).

For the activities listed below we need customer consent for which we will ask at the appropriate place. In case our services are not demanded any more, consent can always be revoked by sending us an e-mail.
